Mr. Paleos has defended individuals charged with traffic violations and criminal charges such as DUI,
felony assault, burglary, theft, computer crimes and domestic violence. He has also represented
individuals in personal injury cases, estate litigation, insurance claims and litigation, and child custody
cases. Mr. Paleos limits his practice for these types of cases to Frederick County, Maryland where his office
is located.
Mr. Paleos currently serves as special litigation counsel for the Small Business Administration as
Receiver for Development Capital Ventures LP, a venture capital fund licensed by the Small Business
Administration. Recently, Mr. Paleos was engaged as in house counsel for a state chartered financial
institution during an orderly transition of control to a state appointed conservator. Previously, he provided
litigation services to a National Title Insurance Company and its insureds following a one year term as an
in-house regional claims counsel for that organization. While in that position, he supervised outside
counsel, reviewed and approved legal fees charged to the organization and he monitored the progress of
litigation in a four state region.
He has served as first chair and lead counsel in numerous jury cases that were tried to final judgment. He
obtained an acquittal of a computer professional indicted under Virginia's Computer Crime statute; a
defense verdict for a sub-prime lender in a three week lender liability case; a multi-million dollar jury verdict
for a secured commercial lender; a jury verdict which successfully quieted title to real property that had been
unmarketable for many years; and a plaintiff’s verdict in the first successful civil RICO prosecution in the
United States District Court for the Eastern District of Virginia.
Mr. Paleos has also had numerous, successful bench trials and summary judgment proceedings
resulting in the set-aside of fraudulent conveyances; acquisition of marketable title through adverse
possession claims; the successful defense of venture capital funds in the context of adversary proceedings
and bankruptcy claims litigation; plaintiffs’ and defense judgments in breach of contract litigation; and
numerous defense verdicts for venture capital funds involving such diverse issues as shareholder rights,
environmental claims, and the defense and prosecution of lift stay and avoidance actions.
Mr. Paleos has prosecuted and defended numerous appeals before the Federal Circuit, the Bankruptcy
Appellate Panel for the First Circuit and the United States Courts of Appeals for the Federal, D.C., First, and
Fourth Circuits. Mr. Paleos’ latest reported decision is DCC Operating, Inc. v. Luis Rivera Siaca (In re
Olympic Mills Corp.), 477 F. 3d 1 (1st Cir. 2007).
Most matters settle prior to verdict. Mr. Paleos successfully obtained favorable settlements with
commercial enterprises for radio and wire piracy under the Communications Act; specific performance and
quiet title actions; mechanics lien litigation; breach of contract cases; employment and discrimination
claims; and international trade cases. He was instrumental in collecting on a multi-million dollar
commercial judgment requiring first chair trial representation in bankruptcy, federal district court, and state
court proceedings that all ended with a global settlement. Mr. Paleos was lead counsel in the prosecution
and successful settlement of one of the first Congressional Accountability Act cases ever brought.
Mr. Paleos has lectured on legal ethics, real estate title issues, title insurance, criminal justice and
business law. In addition, he has published two articles relating to the unique customs, practices, and
procedures used by the Alexandria Division of the United States District Court for the Eastern District of
Virginia - the "Rocket Docket".
